A new visa for skilled workers from Hong Kong

The Migration Amendment (Hong Kong Passport Holders) Regulations 2020 has now commenced and provides further opportunities for Hong Kong passport holders to remain in Australia, with pathways to permanent residency.

The Department of Home Affairs (DoHA) has identified all people who are holding a Hong Kong Special Administrative Region of the People’s Republic of China passport and if the primary visa holder held a Subclass 457, 482 and 485 visa that was in effect on 9 July 2020 their visa has been updated in the DoHA systems with an expiry date of 8 July 2025.

If you have not been notified you should check the Visa Entitlement Verification Online system (VEVO) or seek professional advice from our team of immigration lawyers and registered migration agents.

These visa holders will also be eligible for a pathway to permanent residency at the end of that 5 years.

Future applicants from Hong Kong for temporary skilled visas will be eligible for a 5-year visa, if they:

  • have qualifications listed on the ​occupational skills lists and meet Labour Market Testing requirements, or
  • qualify through the Global Talent temporary visa scheme, which is for exceptional talent where the sponsoring employer pays above the Fair Work High Income Threshold of ​$153,600.

These future temporary skilled visa holders will also be eligible for a 5-year visa with a pathway to permanent residency.
